Cancellation, Return and Delivery Terms
GENERAL
By placing an order electronically through the website you are currently using, you are deemed to have accepted the preliminary information form and the distance sales contract presented to you.
Buyers are subject to the provisions of the Consumer Protection Law No. 6502 and the Regulation on Distance Contracts (Official Gazette: 27.11.2014/29188), as well as other applicable laws regarding the sale and delivery of the purchased product.
Shipping costs, which are the product delivery expenses, will be paid as specified.
Each purchased product shall be delivered to the person and/or institution at the address indicated by the buyer within a legal period not exceeding 30 days. If the product is not delivered within this period, the buyer may terminate the contract.
The purchased product must be delivered completely and in accordance with the specifications stated in the order, along with documents such as a warranty certificate and user manual, if available.
In the event that it becomes impossible to sell the purchased product, the seller is obliged to notify the buyer in writing within 3 days from the date of becoming aware of the situation. The total amount must also be refunded to the buyer within 14 days.
IF THE PRODUCT PRICE IS NOT PAID
If the buyer does not pay the price of the purchased product or cancels it in the bank records, the seller's obligation to deliver the product will cease.
PURCHASES MADE WITH UNAUTHORIZED USE OF A CREDIT CARD
After the product is delivered, if it is determined that the buyer’s credit card used for payment was unfairly used by unauthorized persons, and the price of the sold product is not paid to the seller by the relevant bank or financial institution, the buyer must return the product to the seller within 3 days, with the shipping costs to be borne by the seller.
IF THE PRODUCT CANNOT BE DELIVERED ON TIME DUE TO UNFORESEEN REASONS
If force majeure or unforeseen reasons arise on the part of the seller and the product cannot be delivered on time, the buyer will be informed of the situation. The buyer may request cancellation of the order, replacement with a similar product, or postponement of delivery until the obstacle is eliminated. If the buyer cancels the order: If the payment was made in cash, the amount will be refunded in cash within 14 days from the cancellation. If the buyer made the payment by credit card and cancels the order, the product amount will be refunded to the bank within 14 days of the cancellation, but it may take 2–3 weeks for the bank to reflect the amount in the buyer’s account.
BUYER'S OBLIGATION TO INSPECT THE PRODUCT
The buyer will inspect the goods/services subject to the contract before receiving them; they will not accept damaged, broken, torn packaging, or defective goods/services from the courier. Goods/services that are received will be deemed to be undamaged and intact. After delivery, the buyer must carefully preserve the goods/services. If the right of withdrawal is to be exercised, the goods/services must not be used. The invoice must also be returned along with the product.
RIGHT OF WITHDRAWAL
The buyer may exercise the right to withdraw from the contract by rejecting the goods without any legal or criminal liability and without providing any justification, within 14 (fourteen) days from the delivery date of the purchased product to the buyer or the person/institution at the address they specified, provided that the seller is notified through the contact information below.
11.1. The returned product will first be inspected by the service department of Sumsa Medical Products Manufacturing & Export Ltd. Co. The payment process will begin only if the product is returned in accordance with the return conditions. If the product is deemed suitable for return after inspection, the payment process will begin within 7 business days.
The buyer agrees and undertakes to package the product to be returned in a manner that prevents damage during transportation.
If the buyer exercises the right of withdrawal and the value of the goods decreases due to the buyer’s fault or if the return becomes impossible, the buyer is obliged to compensate the seller/provider for their losses (product cost, expenses incurred to conclude the contract, etc.) in proportion to their fault.
In credit card payments, when the right of withdrawal is exercised, the bank repays the buyer in the same number of installments as the buyer used for the purchase. The refund process by the bank is between the bank and the buyer, and the seller/provider and/or manufacturer bears no responsibility in this regard.
The buyer may not exercise the right of withdrawal for customized products.

WITHDRAWAL PERIOD
If the purchased product is a service, this 14-day period begins from the date the contract is signed. The right of withdrawal cannot be exercised for service agreements in which service provision has started with the consumer’s consent before the withdrawal period ends.
The costs arising from the exercise of the right of withdrawal shall be borne by the seller. In order to exercise the right of withdrawal, written notice must be given to the seller by registered mail with return receipt, fax, or email within the 14 (fourteen) day period, and the product must not have been used within the scope of the "Products for Which the Right of Withdrawal Cannot Be Exercised" provisions of this agreement.
EXERCISING THE RIGHT OF WITHDRAWAL
The invoice of the product delivered to the person or buyer (If the invoice of the product to be returned is corporate, it must be sent back along with the return invoice issued by the institution. Order returns with invoices issued to companies cannot be completed unless a return invoice is issued.)
The return form, the box of the product to be returned, the packaging, standard accessories if any, and the original invoice must be delivered completely and without damage.
RETURN CONDITIONS
The seller is obliged to refund the total amount and return the documents binding the buyer within 10 days at the latest from the date the withdrawal notice is received and to accept the return of the goods within 20 days.
If the value of the goods decreases or the return becomes impossible due to the buyer’s fault, the buyer is obliged to compensate the seller’s damages proportionally. However, the buyer is not responsible for changes and deteriorations that occur due to the proper use of the product within the withdrawal period.
If, due to the exercise of the right of withdrawal, the total amount of the campaign falls below the campaign limit, the amount of the discount used within the campaign will be canceled.
PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED
Products that are prepared in accordance with the buyer’s request or clearly personal needs and are not suitable for return, underwear bottoms, swimsuits and bikini bottoms, makeup products, single-use products, goods that are in danger of spoiling quickly or may expire, products that are not suitable for return for health and hygiene reasons once their packaging is opened after delivery, products that are mixed with other products after delivery and cannot be separated by their nature, periodicals such as newspapers and magazines except those provided under subscription agreements, services performed instantly in an electronic environment or intangible goods delivered to the consumer instantly, sound or video recordings, books, digital content, software programs, data recording and storage devices, and computer consumables whose packaging has been opened by the buyer cannot be returned as per the regulation. In addition, the right of withdrawal cannot be exercised for services that have started with the consumer’s consent before the withdrawal period expires.
Cosmetic and personal care products, underwear, swimsuits, books, reproducible software and programs, DVDs, VCDs, CDs and cassettes, and stationery consumables (toner, cartridge, ribbon, etc.) must be unopened, untested, undamaged, and unused to be returned.
DEFAULT AND LEGAL CONSEQUENCES
If the buyer defaults on payments made by credit card, they agree, declare, and undertake to pay interest within the framework of the credit card agreement with their card issuer bank and to be responsible to the bank. In this case, the relevant bank may pursue legal channels and demand the costs and attorney’s fees from the buyer. In all cases, if the buyer defaults due to their debt, they agree to compensate the seller for the damages and losses suffered as a result of the delayed performance of the debt.
